CMS Releases Guidance on Treatment of Prescription Drugs in MSAs CMS released guidance on the treatment of prescription drugs in Medicare set-asides at the last hour, on December 30, 2005. We realize that many questions will arise regarding Medicare Part D and MSAs. In order to most effectively communicate up-to-date details regarding this issue, we will post frequent articles on our blog. Please take advantage of this free resource to find the most up-to-date, accurate information regarding Medicare set-asides. CMS' Timeframe Stays Relatively Stable The average time from submission of a Medicare Set-Aside proposal until CMS approval received last month approached 19.2 weeks. Although CMS claims to conclude its review process within 45 to 60 days, our statistics show that their process takes significantly longer. Unfortunately, CMS' acknowledgment letter response time has slowed dramatically over the past several months. An average of approximately 41 days passed before we received acknowledgment letters last month. Please note, approval of some of our proposals may require slightly more time than our competitors' proposals because we advocate for the lowest MSA amount that CMS is willing to accept. In comparison, some other firms over-fund MSAs to expedite cases but the end result is significant additional cost to the settling parties.
